"Can't promise" U.S. won't go over fiscal cliff: Treasury Secretary Geithner

(Reuters) - A woman who underwent a full face transplant after being mauled by a chimpanzee will receive about $4 million from the estate of the animal's owner, who has since died, according to media reports on Thursday. Charla Nash was attacked in February 2009, when her friend's 200-pound chimpanzee went on a rampage and ripped off her nose, lips, eyes and hands. The chimp was shot and killed by a police officer. Nash's brother, Michael, filed a lawsuit on his sister's behalf, seeking $50 million from the estate of the chimp's owner, Sandra Herold, who died in 2010. ...

Supreme Court to Determine American Parents' Rights to Retrieve Children Wrongfully Abducted or Retained Abroad

International Family Law Attorney Michael Manely appeals to U.S. Supreme Court to determine all American parents' rights to obtain a court order for the return of children abducted or wrongfully retained abroad. Manely's client, U.S. Army Sergeant 1st Class Jeff Chafin, who served his country in Iraq and Afghanistan, turns now to his country to protect his parental rights.

Washington, D.C. (PRWEB) November 30, 2012

On December 5, 2012, The Supreme Court of the United States will hear oral argument in Chafin v. Chafin, No. 11- 1347, to determine if Federal Courts may order the return of a child abducted or wrongfully retained abroad. The Eleventh Circuit Court of Appeals, Atlanta, GA, held in Bekier v. Bekier, 248 F. 3d 1051 (11th Cir. 2001) that Federal Courts lack jurisdiction to issue such an order once the child is taken from U.S. soil.

On February 6, 2012 the same court denied Sergeant 1st Class Chafin?s request to review a Federal District Court decision allowing his four year old daughter to be taken by his estranged wife to Scotland. The Eleventh Circuit Court held that even if the District Court had erred, they were powerless to issue a return order because the child was no longer in The U.S.

Other Federal Circuit Courts of Appeal disagree, citing the provisions set forth by The Hague Convention on the Civil Aspects of International Child Abduction and The Federal International Child Abduction and Retention Act. The Supreme Court of The United States granted Chafin?s Petition for Writ of Certiorari to resolve the split. Chafin?s international family law attorney, Michael E. Manely, points out that rendering U.S. Courts powerless to order the return of American children would encourage abduction and retention abroad which the Hague Convention on Child Abduction is intended to prevent.

Chafin's daughter was turned over to her Scottish mother by a lower Federal District Court. Attorney Manely explains that the lower court denied his request for a stay and within two hours Chafin's daughter was taken out of the country by her mother, a woman she hadn?t seen in a year. Chafin says even though he served in Iraq and Afghanistan, he has never feared anything more than losing the opportunity to parent his daughter. He is looking to the U.S. Courts to protect his parental rights.

A Pleasure Craft Can Be The Recreation Investment ... - Boating Guide

A Pleasure Craft Can Be The Recreation Investment For Almost Anyone
Water sports are enjoyed by almost everyone and there are few experiences that compare to taking a boat out upon a lake for skiing, fishing, or simply enjoying the wind rushing by and the water spray. The pleasure craft is for many people an essential part of the summer?s recreation and enjoyable by the entire family. This type of sporting activity doesn?t require a huge investment as boats can be as large or small as the budget and the purpose dictate.

While a yacht might be nice for open water and desired by many, the largest boat for leisure activities is not always the best suited for the particular sport or purpose. A small boat with a trolling motor is all that many avid fisherman want or need. The quiet motor and low hull allow them to get in close to the shore and fish without frightening their quarry away.

However, no matter the size of the boat or the purpose there are certain boating laws governing the operation of these craft. Most operators are required to have taken boating safety courses and to have a craft operator card. A boating license is required in most states and is a statement that the operator understands the rules and regulations governing the operation of their craft.

The popularity of boating for leisure has increased and with more recreational boats on the waterways it is more important than ever that the operators be competent and conversant with all laws. Different types of boats require different licensing and competencies but the most common is the pleasure craft boat license.

Boat safety is taken very seriously by most boaters and competency licenses help assure that the boater is up to date on the latest in regulations as well as basic safety measures. A competent craft operator should know many basic safety facts. Knowing how many life vests are required in a leisure boat, who has the right of way at any time and how many people their boat can carry are just a few of the obligations of a boat operator.

Boating laws are important to safety and the regulations may vary from closed lakes to sea going vessels. Classes which teach boat safety and give licenses are important so that the pleasure craft operator emerges knowing what rules govern their craft in almost any situation. The license is merely proof they have taken the classes and passed the competency tests.

People can invest many thousands of dollars in their recreation, this is particularly true of boats used for leisure and sports. They feel the investment is well worth it. However, as valuable as the dollars spent on the craft, is the time spent learning the boat laws and acquiring a boating license.

Whether enjoying the waterways inland, or experiencing the thrill of the open water the competent boat operator can assure that both they and their passengers arrive home safely. Pleasure craft provide leisure time opportunities and a sport that can be enjoyed whether they are young or old. It only makes sense to assure that the operator has all the skills and knowledge possible and a license as well.

Filing for Chapter 7 Bankruptcy | Guest Law Blog | YouBlawg

If you can?t handle the surmounting interest of your debts and it seems the world is toppling down around you, bankruptcy is left as an option. There are several types of bankruptcy you may check out. Each has its own criteria, requirements, and other documents necessary for filing. Why would you need to review the best type of bankruptcy? Courts may dismiss the bankruptcy if you have filed a previous one and you are just using the court to cheat creditors. If you are in great mire of financial bankruptcy, you have to find out the best option to regain your financial freedom and avoid filing another one in the near future.

Of course, your bankruptcy attorney can tell you the requisites of each type of bankruptcy. With the Chapter 7 Bankruptcy you can be discharged of all your debts, after meeting certain requirements. Actually, there is no clear latitude on the criteria of Chapter 7 bankruptcy, but it is the judgment of the court on how well can your income pay the current debts you have. It must be that your capacity to pay the debt, with its interest and other attached fees, is already exhausted. You cannot pay the debt, period.

The current measurement used to determine the capability to pay debts is the average monthly income of the person against the median income of the state. If the average income is less than or just equal to the median of the state income, the person is eligible to file the Chapter 7 Bankruptcy. The court gives higher priority to disabled veterans who have been injured during active duty. Bankruptcy that is due to operation of business may also be given leeway in most courts. If you still know if you are eligible for the Chapter 7 Bankruptcy, it is good to ask a bankruptcy attorney to calculate your capability to repay debts in a five-year period after all living expenses are deducted.

Now that you have determined your eligibility of the Chapter 7 bankruptcy, you need to get a financial and bankruptcy counseling. The problem with most filers is they miss the counseling session. The court will dismiss the bankruptcy appeal if you don?t have a counseling session with accredited counselors.

There are documents you need to file along with the petition for bankruptcy. Of course, you need to prepare financial statements to show incapacity to pay debts, including schedule of assets and liabilities, current cash inflow and outflow, and liabilities or debts included in the petition. Moreover, you must not forget to prepare documents to support leases, contracts, notes, and such others. A means test must also be complied, which will be used by the bankruptcy trustee when evidence of bankruptcy abuse was made in malice.

So why do you need to find a bankruptcy lawyer to help you file the bankruptcy petition at the soonest time when things go south? When the petition has been filed to proper courts in your area or where the business is located, creditors are not allowed to garnish or demand repayment. In filing the petition, you have to bring necessary documents as already mentioned above. Don?t go to the court if you don?t have these documents.

After filing, you wait 20 to 40 days for the scheduled creditors meeting. Creditors will ask you on matters regarding your capability to pay, your properties and other assets which they believe you have included in the debt contract. Don?t worry; most credit companies don?t send representatives to these meetings.

If things go the right way, your debts will be discharged and you can begin a new life. Regain what you have lost.

US Residential Asset Fund, LLC (http://usresifund.com/), implemented a unique strategy by launching as an REO- (real estate-owned) to-Rental fund. Christopher J. Crippen, the Fund?s manager, announced, ?We put together a strategy that allows us to capitalize on the tremendous opportunities available in the REO-to-Rental markets and to support the communities we invest in.

US Residential Asset Fund?s investment strategy is focused on acquiring, renovating, leasing, managing, and exiting distressed single-family properties in multiple U.S. metropolitan areas. Tenants have the option to rent the properties with a ?contract for deed,? paving the road to homeownership for those who otherwise would be lifelong renters. The tenants work with the Fund?s strategic partner, Sagamore Home Mortgage, to resolve their credit challenges, qualify for a mortgage, and purchase the home they are renting.

Mr. Crippen, an industry expert, explained, ?This is really a unique Fund. We can do something good for the communities we invest in, enable our tenants to become homeowners, and provide double-digit returns for our investors. It?s a win-win-win strategy, which is hard to find in this market. I am proud to be a part of it.?

US Residential Asset Fund?was founded by Mr. Crippen, Dana Bradley, Al Espinoza, Patrick Cipolla, and Amos Alexander. Focusing on the $3 trillion single-family rental market, the Fund expects to invest more that $20 million over the next two years, beginning with acquiring assets in the Charlotte, Memphis, and Chicago, MSAs. Phase two acquisitions will be in the Atlanta, Indianapolis, Tampa, Orlando, MSAs.

?My partners, Innotion Enterprises, Inc. (www.innotion.com), and Performance Holdings (http://www.performanceholdings.com/), have been operating in the single-family and REO arenas, and have built a world-class acquisition, renovation, and management platform uniquely designed for these properties,? Mr. Crippen continued. ?We work with Sagamore Home Mortgage to work with our tenants to qualify them to purchase our properties.? Christopher J. Crippen formerly headed Prescient Asset Management?s FDIC ORE Disposition.

Mr. Crippen described how the program works, saying, ?All of our properties are offered as ?rent to own? (RTO) to our tenants. This encourages homeownership in the markets we are investing in. Studies show that RTO tenants take better care of their properties than strictly rental tenants. The benefits are a more secure investment and the ability to give back to the communities in which we invest. It?s a win-win-win situation.?
