Daily Kos: Rethinking Hobby Lobby - A Legal Argument Against ...

Hobby Lobby Stores, Inc. is based in Oklahoma City, and as its name indicates, it is a registered corporation. Companies do not have to incorporate, you see. It's perfectly possible for a business owner to run his business without ever adding that colorful "Inc." to the end of his company's moniker. But David Green incorporated his picture frames business at some point during its formative years.

Just why did he choose to do that? The reasons are many, and they lie at the heart of why David Green is dead wrong in his current line of argumentation. Any second year law student can identify the first reason for incorporation. That's the protection of the business owner's personal assets from liability. When a company is incorporated, the business's owners are protected by a corporate veil of sorts. In the vast majority of instances, they cannot be sued personally for a host of things that might bite into corporate profits. If a person slips and falls at a Hobby Lobby store, he might seek a judgement from the company, but he will not be able to sue David Green personally. If the company goes bankrupt, chances are good that a creditor will not be able to go after David Green's personal riches.

This is important for David Green, too. This God-fearing Christian is worth $4.5 billion according to Forbes. By availing himself to a corporate designation, Green shields himself from any liability beyond that incurred by the company.

Incorporation also affords the company a sort of perpetual existence. When the owner of a sole proprietorship dies, the company is buried with him. If the business is incorporated, it outlives its original founder. This designation provides a level of independence for the company, giving it a legal identity that's distinct from the identity of its owner. In addition, incorporation allows a company to sustain itself through periods of leadership turnover. Steve Jobs was once booted out of the company he started. This couldn't happen if he operated his computer business without a corporate structure.

A more schooled tax attorney or corporate lawyer might also explain the tax advantages of incorporation. Business owners like David Green benefit immensely from the ability to pass money through places like Hobby Lobby.

What is the point of this exercise? It's to point out two very important things. First, laws surrounding incorporation are designed specifically to separate the business owner as a legal entity from the business as a legal entity. Second, these laws are in place mostly for the benefit of the business owner. David Green is willing to avail himself to the standard protections of the corporate legal structure though he is unwilling to comply with the other requirements of operating a business.

When it comes time for the latest slip and fall plaintiff to file his lawsuit, he cannot pierce the corporate veil to get to David Green personally. If the time comes when an unsecured creditor wants to make a claim against Green in lieu of his bankrupt business, Green will hide like a matador behind his crimson red veil. The legal distinction between business owner and incorporated business is fine by Green when it cuts in his favor to provide a shield for his personal wealth. When it comes to his company complying with federal law to provide contraception to employees, though, Green sheds the veil, arguing for a sort of perverse legal intercourse between business and business owner.

This is the petulant operation of a pariah who wants more than just to have his cake and eat it, too. He also wants a well-maintained waist line when he gets done with that cake. Green and business owners like him take full advantage of the ability to participate in a diverse, secular, and regulated marketplace. They succeed for a number of reasons, including savvy ownership, strong fiscal fundamentals, and creative ideas. But they also succeed because of the protections offered by the structure of the business world. Is there any question that David Green would cease to run 500 craft stores if every slip and fall could mean a lawsuit that he would have to personally appear for? If this man continues to take full advantage of the corporate structure which draws a distinct legal separation between him and his business, then he must recognize the severance between his own religious beliefs and the religious "beliefs" of his company. Green must come to understand that his company lacks the spiritual soul that he believes in, and as a result, it's not bound by the religious obligations of his Bible and it's not going to be judged by the gatekeepers of either heaven or hell.

And as I wrote before - if he's uncomfortable with this truth, then he has a very real option. He can take his ball and go home. If his religious "morality" overruns his greed, then maybe he should choose to run no business at all. Or perhaps he should run a business that's not incorporated, where his religion can mate with his business but his riches would be fair game for potential claimants? I've read the Bible, and Jesus told people like David Green that following heavenly commands wouldn't be easy.

9 die as tour bus crashes on icy Oregon highway

PENDLETON, Ore. (AP) ? The stretch of rural Oregon interstate where a tour bus crashed through a guardrail and plummeted 100 feet down a steep embankment is so notorious that state transportation officials have published a specific advisory warning of its dangers.

Nine people were killed and more than two dozen injured when the charter bus veered out of control around 10:30 a.m. Sunday on snow- and ice-covered lanes of Interstate 84 in eastern Oregon, according to the Oregon State Police.

The bus crashed near the start of a 7-mile section of road that winds down a hill. It came to rest at the bottom of a snowy slope, landing beaten and battered but upright with little or no debris visible around the crash site.

The East Oregonian said it spoke with two South Korean passengers, ages 16 and 17. Both said through a translator that they were seated near the rear of the bus when it swerved a few times, hit the guardrail and flipped. They described breaking glass and seeing passengers pinned by their seats as the bus slid down the hill. Both said that they feared for their lives.

The paper said that the teens, one of whom injured a knee and the other suffered a broken collarbone, were staying at a hotel arranged by the Red Cross.

More than a dozen rescue workers descended the hill and used ropes to help retrieve people from the wreckage in freezing weather. The bus driver was among the survivors, but had not yet spoken to police because of the severity of the injuries the driver had suffered.

Lt. Gregg Hastings said the bus crashed along the west end of the Blue Mountains, and west of an area called Deadman Pass. The area is well known locally for its hazards, and the state transportation department advises truck drivers that "some of the most changeable and severe weather conditions in the Northwest" can lead to slick conditions and poor visibility. Drivers are urged to use "extreme caution and defensive driving techniques," and warned that snow and black ice are common in the fall through the spring.

The bus had been carrying about 40 people. St. Anthony Hospital in Pendleton treated 26 of them, said hospital spokesman Larry Blanc. Five of those treated at St. Anthony were transported to other facilities.

Blanc did not elaborate on the nature of the injuries but told the Oregonian that the hospital brought in additional staff to handle the rush of patients and did a lot of X-ray imaging.

I-84 is a major east-west highway through Oregon that follows the Columbia River Gorge.

Umatilla County Emergency Manager Jack Remillard said the bus was owned by Mi Joo travel in Vancouver, B.C., and state police said the bus was en route from Las Vegas to Vancouver.

A woman who answered the phone at a listing for the company confirmed with The Associated Press that it owned the bus and said it was on a tour of the Western U.S. She declined to give her name.

A bus safety website run by the U.S. Department of Transportation said Mi Joo Tour & Travel has six buses, none of which have been involved in any accidents in at least the past two years.

The bus crash was the second fatal accident in Oregon on Sunday morning. A 69-year-old man died in a rollover accident on I-84, about 30 miles west of where the bus accident took place.

A spokesman for the American Bus Association said buses carry more than 700 million passengers a year in the United States.

"The industry as a whole is a very safe industry," said Dan Ronan of the Washington, D.C.,-based group. "There are only a handful of accidents every year. Comparatively speaking, we're the safest form of surface transportation."

Sunday's Oregon bus crash comes more than two months after another chartered tour bus veered off a highway in October in northern Arizona, killing the driver and injuring dozens of passengers who were mostly tourists from Asia and Europe. Authorities say the driver likely had a medical episode.

SANTEE, Calif. (AP) ? California Authorities say a pilot from Phoenix, his wife and daughter were killed when a home-built airplane crashed in a San Diego County nature preserve.

Sheriff's Lt. Scott Amos says the single-engine plane went down Saturday morning within Sycamore Canyon Open Space Preserve near Santee. Medical examiners said the dead included a 65-year-old man, his 53-year-old wife and their 19-year-old daughter.

Federal Aviation Administration spokesman Ian Gregor says the four-seat Lancair IV-P had departed from San Diego's Montgomery Field en route to Deer Valley Airport in Phoenix.

The FAA and the National Transportation Safety Board are investigating.

The Lancair web site says the IV-P is one of a series of aircraft kits that are no longer in production

Gang-rape victim's body cremated privately in India

NEW DELHI (AP) ? A young woman who died after being gang-raped and beaten on a bus in India's capital was cremated privately as millions of grieving, angry residents demanded greater protection for women from sexual violence.

The cremation took place during a private ceremony in New Delhi soon after the woman's body arrived in the capital Sunday on a special Air India flight from Singapore, where she died at a hospital Saturday after being sent for medical treatment.

The attack has forced India to confront the reality that sexually assaulted women are often blamed for the crime, forced to keep quiet and discouraged from going to authorities for fear of exposing their families to ridicule. Police often refuse to accept complaints from rape victims, and the rare prosecutions that reach courts can drag on for years.

Prime Minister Manmohan Singh and Sonia Gandhi, head of the ruling Congress party, were at the airport to receive the woman's body and meet family members of the victim who were on the flight. Security was tight, with no access to the public or media at the crematorium.

Six men have been arrested and charged with murder in the attack on a New Delhi bus on Dec. 16. Police spokesman Rajan Bhagat said they face the death penalty if convicted.

The woman, who has not been identified, was first treated at a New Delhi hospital before being moved to Singapore's Mount Elizabeth hospital, which specializes in multi-organ transplants. The attackers inserted an iron rod into the woman's body, severely damaging her organs.

Following her death, thousands of Indians lit candles, held prayer meetings and marched through cities and towns Saturday night to express their grief and demand stronger protection for women and the death penalty for rape, which is now punishable by a maximum of life imprisonment.

But in a sign of how pervasive such crimes are, police in West Bengal state were investigating another suspected gang-rape and death.

The family of a woman said she and her husband were attacked by six men as they returned home after working at a brick factory. They dragged the woman into a nearby farm after pouring acid into her husband's mouth, the family said.

The woman was found dead with multiple injuries, said police officer Bhaskar Mukherjee, adding he was waiting for an autopsy report.

No charges have been laid. Another police officer, Sugata Sen, said four men had been detained for questioning.

In the capital, dozens of protesters tried to break through a police cordon Sunday and march to the parliament building but were pushed back. The protesters, belonging to the student wing of main opposition Bharatiya Janata Party, shouted anti-government slogans as they marched.

Hundreds of policemen have sealed off the high-security area, where the seat of India's government is located, in anticipation of more protests. The area is home to parliament, the president's palace, the prime minister's office and several ministries.

Gandhi assured the protesters in a statement that the rape victim's death "deepens our determination to battle the pervasive, the shameful social attitudes and mindset that allow men to rape and molest women and girls with such an impunity."

Attitudes by Indians toward rape are so entrenched that even politicians and opinion makers have often suggested that women should not go out at night or wear clothes that might be seen as provocative.

A statement from U.N. Secretary-General Ban Ki-moon said he offered condolences to the victim's family and urged India's government to take steps to deter such crimes and strengthen services for victims.

"Violence against women must never be accepted, never excused, never tolerated," the statement said. "Every girl and woman has the right to be respected, valued and protected."

NBA standings 2012: Clippers separating themselves

The Clippers are the hottest team in the NBA right now, and have created some distance from the rest of the division.

The Los Angeles Clippers have won 16 in a row, and have pulled out in front of the NBA's Pacific Division by four games over the surprising Golden State Warriors. The Lakers have climbed to .500, but are still nine games behind the Clippers for the division lead.

The Clippers' hot streak has catapulted them to the top of the Western Conference standings with a 24-6 record. They are two games up in the win column over the Oklahoma City Thunder. The Lakers are tied with the Blazers and for the eighth and final playoff spot in the West, but could start making a move with the return of point guard Steve Nash.

Out East, the Heat are on top of the conference heap. They sit at 20-7, a half-game ahead of the New York Knicks. The Hawks are close behind, two games back of Miami. The Pacers are the fourth division leader, and have won four-straight to get within four games of the leaders.

As many of you have seen the first in our the video series we named ?MS At Home? ? and the response has been quite popular ? I wanted to make sure you were all aware of the continuing series.

The third video in the multiple sclerosis series of 6 short segments posted yesterday and is already stirring conversations. (if you missed the second MS video in the series that will play right after the current offering.

In this interview with Sharon Dodge and Bobbie Severson, we talk about the family connection with MS. Mrs. Dodge was diagnosed with MS just 8 years after her father lost his battle with a particularly aggressive form of the disease. Now, she fights the good fight for herself and her three children; hoping they never hear the words ?You have MS.?

As we head into the New Year?s weekend, I thought that her words of hope and inspiration were a proper way to end 2012 and look forward to 1212.

Nurse Practitioner, Bobbie Severson from the Swedish MS Center gives some very interesting figures as to the propensity of MS in families if one member has MS (we?re talking a jump from 1:750 to 1:40~!

56% of female university students get drunk in record time, Spanish study suggests

Dec. 28, 2012 ? Researchers from the HealthyFit group at the University of Vigo have studied university students' lifestyles; their analysis, which includes alcohol and illegal drug consumption habits, sport and food, concludes that most students indulge in unhealthy behaviour. One of the main results of the study points to the high consumption of alcohol.

"The amount drunk per unit of time is higher among women. In other words, even though male students drink more often, females do so more intensively in shorter periods of time, which is known as binge drinking," explained Jos? M? Cancela Carral, co-author of the study published by the Journal of Environmental Research and Public Health.

Researchers randomly selected 985 students from different degree courses and in different years at the University of Vigo.

Of the females interviewed, 51.2% lead a sedentary lifestyle, while the percentage in males is 41.7%. When analysing students who maintain an appropriate level of physical activity, 38.6% of males do physical exercise, as opposed to only 20.9% of women.

"We were also surprised by the high consumption of illegal drugs among university students -- 44.9% of men and 30.9% of women -- which we understand could lead to significant future health problems, mainly related to the nervous system," underlined the researcher.

Anomalous attitudes to food were more evident among women (16.6%), although also present among men (8.8%). "However, the statistical analysis showed that this parameter depended on the degree the student was studying for," added Cancela. Such attitudes were much more common among those studying degrees related to education (19.2%) than among those studying courses related to health (6.3%).

Health network

Spanish universities set up a Healthy University Network in 2008, a project for healthy living for universities from all over Spain, the Spanish University Rectors' Association, the Ministry of Health, Social Services and Equality, the Ministry of Education, Culture and Sport and some regional public health entities.

In the researcher's opinion, at many universities this network was nothing more than "a simple first step to get on the list and nothing else"; hence transversal content should be implemented in study plans related to food, physical exercise and healthy habits.

"In the light of the results, training and information courses are required in these areas, together with healthy leisure -- not just sports facilities -- to set up university guidance services for a healthy student lifestyle," concludes Cancela.

Genetic predisposition

A recent study published in the PNAS journal argues that the gene called RASGRF2 could be related to a predisposition to getting drunk.

According to scientists, this gene regulates the predisposition to drink excessive amounts of alcohol as it influences mesolimbic dopamine neuron activity, which is one of the ways dopamine is taken from one region of the brain to another.

Gunter Schumann, one of the main authors of the study, explained that even though we should not consider said gene to be the main cause -- as there are many environmental factors and other genes involved -- the study thereof helps to explain why some people are more vulnerable to alcohol than others.

Residents return home after NY fatal shooting

WEBSTER, N.Y. (AP) ? Residents of a suburban Rochester, N.Y., neighborhood gutted by a fire set by a man who gunned down four volunteer firefighters have been allowed to return to their homes.

Local media outlets report that authorities began letting homeowners return to their properties in Webster on Tuesday, a day after 62-year-old William Spengler shot four firefighters, killing two, after setting the pre-dawn blaze that destroyed seven homes along Lake Ontario and damaged two others.

Some of Spengler's neighbors described how they were awoken early Monday morning by gunfire nearby, followed by the arrival of police SWAT team members who used an armored vehicle to evacuate more than 30 residents.

Police say Spengler's body later was found near his home. Authorities say the ex-convict died of a self-inflicted gunshot wound.

Health Issues Make Kids Bullying Targets

Bullying over health issues is common, according to two studies looking at kids with food allergies and those going through weight-loss programs.

In one study, almost 32% of children with food allergies reported bullying or harassment specifically related to their allergy, often involving threats with food, Eyal Shemesh, MD, of Mount Sinai Medical Center in New York City, and colleagues found.

In a second study, 64% of teens at weight-loss camps reported weight-related victimization, not just by schoolmates but often by friends, coaches, teachers, and parents too, Rebecca Puhl, PhD, of Yale University, and colleagues reported.

Both studies appeared online in Pediatrics.

Because of the immediate and long-term physical and emotional effects, pediatricians and other clinicians should get involved in concrete ways, advised Mark Schuster, MD, PhD, of Boston Children's Hospital, and Laura Bogart, PhD, of Harvard Medical School in Boston, in an accompanying commentary.

They recommended anticipatory guidance for children and parents by describing bullying and its consequences and teaching parents how to recognize clues that it's occurring.

"In addition, clinicians can learn to recognize indicators of possible bullying such as unexplained bruises, cuts, and scratches, as well as school avoidance, social isolation, anxiety, depression, substance use, and chronic physical symptoms (e.g., headaches, stomachaches). They should be particularly alert when patients have stigmatizing characteristics that could lead to bullying (e.g., obesity, disabilities, gender nonconformity)."

Shemesh's group analyzed surveys of 251 established food allergy patients, ages 8 to 17, and their parents at a single allergy clinic in the Enhancing, Managing, and Promoting Well-Being and Resiliency program.

Any bullying or harassment of these children was reported by 45% of them and 36% of their parents, although with poor agreement when related to reasons other than the food allergy.

Being victimized due specifically to food allergies accounted for most of these cases, with 32% of the food allergic kids and about 25% of their parents reporting such bullying.

Almost all the bullies were classmates (80%), and most bullying happened at school (60%).

The most common form was teasing (42%), followed by waving the allergen in front of the child (30%).

Notably, 12% had been forced to touch the food they are allergic to and 10% had food thrown at them.

Bullying was significantly associated with poorer quality of life scores and greater anxiety, which the researchers noted was independent of allergy severity.

While most of the bullied kids said they had told someone about what happened, parents knew in only about half of the cases.

When parents did know, though, it was associated with better quality of life and less distress in the bullied children.

To increase disclosure of bullying, "clinicians might consider asking a screening question about bullying during encounters with children with food allergy," Shemesh's group suggested.

While it's hard to compare the results with those of other studies, general population rates appear to be 17% to 35%, suggesting that food-allergic children may be bullied or harassed more than their peers, they pointed out.

"This finding, although alarming, is not surprising, given that children with food allergies have a vulnerability that can be easily exploited," they wrote.

(AP) ? The ex-con who lured two firefighters to their deaths in a blaze of gunfire left a rambling typewritten note saying he wanted to burn down the neighborhood and "do what I like doing best, killing people," police said Tuesday as they recovered burned human remains believed to be the gunman's missing sister.

Police Chief Gerald Pickering said 62-year-old William Spengler, who served 17 years in prison for the 1980 hammer slaying of his grandmother, armed himself with a revolver, a shotgun and a military-style rifle before he set his house afire to lure first responders into a death trap before dawn on Christmas Eve.

"He was equipped to go to war, kill innocent people," Pickering said.

The rifle he had was a military-style .223-caliber semiautomatic Bushmaster rifle with flash suppression, the same make and caliber weapon used in the elementary school massacre in Newtown, Conn., Pickering said.

The chief said police believe the firefighters were hit with shots from the rifle given the distance but the investigation was incomplete.

Pickering declined to divulge the full content of the two- to three-page note left by Spengler or say where it was found, but read one line from it: "I still have to get ready to see how much of the neighborhood I can burn down, and do what I like doing best, killing people."

The human remains were found in the charred house that Spengler shared with his 67-year-old sister, Cheryl. A medical examiner will need to determine the identity and cause of death because the body is badly burned.

Spengler killed himself as seven houses burned around him Monday on a narrow spit of land along Lake Ontario in this suburb of Rochester. A friend said Spengler hated his sister but the chief said the note left by him did not give a motive.

No other bodies were found, and police late Tuesday said the on-scene investigation had been completed.

Two firefighters were shot dead in the ambush and two others are hospitalized in stable condition.

Spengler fired at the four firefighters when they arrived shortly after 5:30 a.m. Monday to put out the fire, Pickering said. The first police officer who arrived chased the gunman and exchanged shots.

Authorities said Spengler hadn't done anything to bring himself to their attention since his parole. As a convicted felon, he wasn't allowed to possess weapons. Monroe County District Attorney Sandra Doorley said Spengler led a very quiet life after he got out of prison.

A friend, Roger Vercruysse, lived next door to Spengler and recalled a man who doted on his mother, whose obituary suggested contributions to the West Webster Fire Department.

"He loved his mama to death," said Vercruysse, who last saw his friend about six months ago.

Vercruysse also said Spengler "couldn't stand his sister" and "stayed on one side of the house and she stayed on the other."

The West Webster Fire District learned of the fire after a report of a car and house on fire on Lake Road, on a narrow peninsula where Irondequoit Bay meets Lake Ontario, Monroe County Sheriff Patrick O'Flynn said.

Emergency radio communications capture someone saying he "could see the muzzle flash coming at me" as Spengler carried out his ambush. The audio posted on the website RadioReference.com has someone reporting "firefighters are down" and saying "got to be rifle or shotgun - high powered ... semi or fully auto."

Two of the firefighters arrived on a fire engine and two in their own vehicles, Pickering said. After Spengler fired, one of the wounded men fled, but the other three couldn't because of flying gunfire.

The police officer who exchanged gunfire with Spengler "in all likelihood saved many lives," Pickering said.

The dead men were identified as police Lt. Michael Chiapperini, 43, the Webster Police Department's public information officer; and 19-year-old Tomasz Kaczowka, also a 911 dispatcher.

Pickering described Chiapperini as a "lifetime firefighter" with nearly 20 years in the department, and he called Kaczowka a "tremendous young man."

The two wounded firefighters, Joseph Hofstetter and Theodore Scardino, were in stable condition Tuesday at Strong Memorial Hospital, the chief said. Both were awake and alert and are expected to recover.

Hofstetter, also a full-timer with the Rochester Fire Department, was hit once in the pelvis, and the bullet lodged in his spine, authorities said. Scardino was hit in the chest and knee.

The shooting and fires were in a neighborhood of seasonal and year-round homes set close together across the road from the lakeshore. The area is popular with recreational boaters but is normally quiet this time of year.

Israel: No proof chemical weapons used in Syria

JERUSALEM - Israel voiced doubt on Tuesday about claims that chemical weapons had been used against rebels fighting to topple President Bashar Assad.

Activists on Monday claimed civilians had suffered injuries consistent with exposure to some kind of poisonous gas.

"We have seen reports from the opposition. It is not the first time. The opposition has an interest in drawing in international military intervention," Vice Prime Minister Moshe Yaalon said on Army Radio.

"As things stand now, we do not have any confirmation or proof that (chemical weapons) have already been used, but we are definitely following events with concern," he said.

Syria activists: Several die after Assad's forces use 'poisonous gases'

The Syrian Observatory for Human Rights gathered activist accounts on Sunday of what they said was a poison gas attack in the city of Homs. The reports are difficult to verify, as the government restricts media access in Syria.

The Observatory, a British-based group with a network of activists across Syria, said those accounts spoke of six rebel fighters who died after inhaling smoke on the front line of Homs's urban battleground. It said it could not confirm that poison gas had been used and called for an investigation.

Syria has said it would never use chemical weapons against its citizens.

Asked about images purported to show patients being treated for possible gas poisoning, Yaalon said: "I'm not sure that what we're seeing in the photos is the result of the use of chemical weapons.

"It could be other things," he said, without elaborating.

On Sunday, senior Israeli defense official Amos Gilad said Syria's chemical weapons were still secure despite the fact that Assad had lost control of parts of the country.

As Syria's southern neighbor, Israel has been concerned about chemical weapons falling into the hands of Islamist militants or Lebanese Hezbollah fighters, cautioning it could intervene to stop such developments.?

Earlier this month, President Barack Obama warned Assad that the?use of chemical weapons by his regime would be "totally unacceptable.""If you make the tragic mistake of using these weapons there will be consequences and you will be held accountable," he said.

Is air marshal program a model for schools?

WASHINGTON (AP) ? The former congressman who's heading the National Rifle Association's school emergency response program that would include volunteers to help guard children says it makes sense because it's similar to placing air marshals on planes.

Asa Hutchinson tells ABC's "This Week" that the air marshal program has provided a deterrent and made flying safer.

He says putting trained guards such as retired police officers or military persons at schools will help protect students. Hutchinson says hiring guards to defend schools is a "very reasonable approach" but it should be a local choice.

New Jersey Gov. Chris Christie, a prominent Republican, says the approach will turn schools into an armed camp for kids.

MIAMI (CBSMiami) ? A Christmas Eve drive was held to help a southwest Miami-Dade family who lost everything when their home was destroyed in a fire on Sunday.

The Rodriguez family, who lived in the home at 15200 SW 184th Street, was able to get out safely before the swift moving fire gutted their home, according to Miami-Dade Fire Rescue spokesman Lt. Arnold Piedrahita Jr.

Everything in the home, including Christmas gifts for the couple?s 13-year old son and seven-year old daughter, was destroyed.

Pastor Luis Couvertier organized the drive at the children?s school ? Gladeview Christian School at 12201 SW 26th Street.

?Out of nowhere I heard my son screaming ?fire, fire, fire,?? said Haender ?Cubita? Rodriguez, a professional MMA fighter. ?I blinked and man, everything was gone!?

Rodriguez?s 13-year-old son and seven-year-old daughter were both inside the home at the time of the fire, and with their father?s help, were able to make it out safely.

Rodriguez?s wife, Aymara, was at work when she says she got an email alert about the fire.

?I started calling the house and there was no answer, so I panicked and started calling and calling my mom and nobody would answer,? said Mrs. Rodriguez.

She then rushed home, where she found her husband and kids safe. Mrs. Rodriguez and her husband say they can only take everything from here one step at a time.

?We live day by day. I?m going to keep asking my God to give me another day pretty much,? he said.
?If I get one more day, with God?s help I?ll make it happen for us again.?
