Home prices climb for 2nd month in row

U.S. single-family home prices edged higher in March, the second month of gains in a row, adding?to signs the housing market is stabilizing, a closely watched survey said on Tuesday.

The S&P/Case Shiller composite index of 20 metropolitan areas gained 0.1 percent in March on a seasonally adjusted basis, falling shy of economists' forecasts for a gain of 0.2 percent.

On an unadjusted basis, the index was unchanged. Prices in the 20 cities were down 2.6 percent year over year, improving from the 3.5 percent yearly decline seen last month.

Still, the major indexes ended the first quarter at new post-crisis lows, the report said. For the first quarter, prices were down 2 percent, compared to a 3.9 percent decline in the last three months of 2011.

Tuesday's data was another piece of evidence recently that the housing market is?making a bumpy revival. The median price for a new home rose 4.9 percent in April, year over year, while sales of existing homes rose 10 percent last month versus April 2011.

"In my mind there is no question that housing has bottomed, in terms of home sales, home construction and home prices but the recovery is still going to be very modest or very sluggish," said Mark Vitner, senior economist for Wells Fargo Securities.

Housing has a long way to go, though. Nearly 16 million homeowners owed more on their mortgages than their home was worth in the first quarter, or nearly one-third of U.S. homeowners with mortgages.

"There are still so many unanswered questions in front of us, such as what has happened to attitudes toward home ownership. We know there has been some change to that. Also we don't know what is going to happen with Fannie Mae and Freddie Mac, what is the government's role in mortgage financing going to be? We are not going to be able to settle that until after the election," Vitner said.

Washington freshman golfer Cheng-Tsung Pan is "a man among boys"

For a phenom, Cheng-Tsung Pan is pretty normal. He stands 5 feet 6 and weights 152 pounds. He uses his library voice at all times. And he has this terrible habit of making his extraordinary feats sound like something any novice golfer could do.

Pan plays golf with the precision of a surgeon, the focus of a philosopher ? and the bravado of a sheepish boy asking out a girl for the first time. Someone ought to tell him that he is, as actor Will Ferrell's Ron Burgundy character would say, kind of a big deal. But the Washington freshman is too consumed with getting the most out of his enormous talent.

"I need to improve," Pan says, almost in desperation.

It's an ideal attitude for any athlete, but the mentality is especially heartening coming from Pan, who is one of the greatest recruits in any sport ever to step foot on campus. Pan came to Washington as a nationally ranked amateur golfer. In 2007, at age 15, he was the youngest amateur since Bobby Jones in 1920 to reach the quarterfinals of the U.S. Amateur. In 2009, he was the youngest stroke-play medalist ever in the Western Amateur, and he repeated the feat the next year.

The Taiwan native, who left home five years ago to come to the United States and go to school at the Leadbetter Golf Academy in Bradenton, Fla., has followed with a quality first season with the Huskies. He is currently ranked 14th in the World Golf Amateur Rankings. Junior Chris Williams, who is ranked No. 4, leads the Huskies, and the two golfers are a potent combination that makes the eighth-ranked Huskies legitimate contenders at the NCAA men's golf championship, which will be held Tuesday through Sunday at The Riviera Country Club in Pacific Palisades, Calif.

Washington coach Matt Thurmond doesn't have his deepest team, but he's bringing five "steady, consistent and quietly tough" golfers to the championship. If the Huskies can survive 54 holes of stroke play and stay alive when the field is whittled down from 30 teams to eight, then the national champion is decided by match play. And at the top, the Huskies have Williams and Pan, who are "two guys I know at any time can beat anybody," Thurmond says.

The coach can be certain that Pan, despite being a freshman on a big stage, will play his game. That's where his greatness lies. He's not flashy. He doesn't wow you with long drives. But he has a seasoned game. His accuracy off the tee is remarkable. His wedge play is impeccable. And he doesn't beat himself.

"From a maturity standpoint, he is a man among boys," Thurmond says of Pan. "He is like a 35-year-old Tour player when it comes to preparation and focus and not making mental mistakes."

Pan, 20, says he has improved his putting and learned to be a teammate at Washington. He came to the U.S. to develop and get an education, and though it's common for Taiwanese players to turn pro at an early age, he wants to be more than a golfer.

His journey has been difficult at times. Learning English was a challenge, but now he speaks and comprehends it well. But the hardest part of this transition came two years ago when Pan's father, Jung-Ho Pan, died of cancer.

Cheng-Tsung, the youngest of six siblings, decided not to return to Taiwan for the funeral. The family felt it was too risky.

"In Taiwan, if you are 18 years old, you need to show that you are in college," Pan says. "Otherwise, you must be a soldier for one year. It's just a government policy, I guess."

Pan still has trouble talking about missing the funeral.

"I just feel so bad," he says. "I look at it as my responsibility. When you fail to finish your responsibility, you don't feel good. I needed to be my dad's child and be there. But I wasn't. I had a harsh time."

His father was an elementary school math teacher, and his mother was a caddie at a local golf course. Pan became interested in the sport at age 5, and when he was 8, his father would take him to a golf course regularly. The distance from the entrance to the course was three miles, so Pan would get out of the car and run to the clubhouse. After the run, the boy would have breakfast with his dad and then practice for several hours.

During a windy afternoon at the Bandon Dunes Championship in Oregon in March, Pan told Thurmond that he had played in a typhoon while growing up. When Thurmond asked for more information, he learned that it was another method Pan's father used to make him a tougher golfer.

"It's intimidating when you get a guy already this good," Thurmond says. "You want him to improve, but you don't want to screw him up."

Pan is thriving at Washington. He loves the coaching, the competition and camaraderie on the team and even the Seattle weather.

"I like the fact that the school is in the city, that it's part of something bigger," Pan says. "I don't like college towns."

Pan has three more years to explore the city. And win championships. And add to his already stunning list of accomplishments.

It's what his father wanted for him.

"I think he's still watching me now," Pan says.

African refugees in Israel get a cold shoulder and worse

TEL AVIV ? The first Molotov cocktail ignited a backyard fence, just a couple of feet from where three Eritrean refugees were sleeping outdoors on makeshift beds of wood planks atop old TV sets. One man burned his arm trying to extinguish the flames with a blanket.

Moments later, a second firebomb was tossed through an open air vent into the adjacent apartment, where another family of African asylum-seekers was sleeping. It exploded in the shower without causing injury.

The post-midnight attacks last month by unknown assailants continued across Tel Aviv's dilapidated Shapira neighborhood, striking another refugee house and a kindergarten catering to African children.

"We're just looking for some peace in our life," said Berhun Gergrehra, 60, a former Eritrean soldier who fled poverty and repression there two years ago, arriving in Israel after walking through Sudan and Egypt with his teenage son and daughter. "But everyone here just hates us. Why?"

Israel is a nation founded by refugees, mostly Jews escaping persecution in Europe and the Middle East. It grew and prospered thanks to additional immigration from Russia, Ethiopia and other nations.

But now Israel's identity as a refuge is being challenged by an influx of tens of thousands of Africans, who also see the country as a haven from oppression in their native lands. Since 2006, more than 60,000 Africans ? mostly from Eritrea and Sudan, including the latter's Darfur region ? have poured over the border from Egypt's Sinai desert, taking advantage of Israel's proximity as one of the nearest modern democracies accessible to African refugees.

But unlike past waves of Jewish immigrants, the flood of Africans is triggering an ugly and sometimes violent backlash in Israel. Refugee activists say some government leaders are fostering the intolerance and anger toward Africans, who are accused of committing crimes, stealing jobs from Israelis and potentially undermining the Jewish character of the country.

At a Tel Aviv rally last week, hundreds of Israelis gathered to protest the presence of African refugees. Right-wing lawmaker Miri Regev called Sudanese arrivals a "cancer" on Israel and urged immigration officials to deport all African "infiltrators."

Soon after, angry mobs rioted through the neighborhood, smashing store windows and attacking a car carrying Africans, police said. Seventeen rioters, mostly minors, were arrested.

It was the latest in a string of attacks, disturbances and incidents of harassment in the last month, after three Eritrean migrants were arrested in connection with the rape of an Israeli woman.

Amid a national uproar over the rape, Interior Minster Eli Yishai called most African immigrants "criminals" and vowed to either deport or jail them. He said on Israel Radio that a firm response was the only way to discourage more refugees from entering the country. "Once they're in jail, they won't want to come over here anymore," he said.

Prime Minister Benjamin Netanyahu echoed the sentiment, saying the presence of African migrants in Israel "is extremely serious and threatens Israel's social fabric and national security."

Most of the African refugees walk into Israel via the Sinai desert, paying Bedouin smugglers thousands of dollars to deliver them from Egypt. In response, the Israeli government has begun construction of a massive fence along the border and an 8,000-bed detention facility in the southern Negev desert to hold those who get through. Both are expected to be completed this year.

After a brief detention at a military facility, most African refugees are released without government assistance and are given short-term visas that prohibit them from working. Many end up homeless in the resort city of Eilat or in the poor areas of cities like Tel Aviv, where they sleep in parks and seek jobs as construction workers or dishwashers, for which they are paid under the table. Children are allowed to attend school, but their parents receive no health insurance or other social benefits.

Interior Ministry officials say they are doing their best to deal with the influx, their goal being to provide basic protection without offering so much that it will encourage more arrivals.

"There's a pull factor," said Daniel Solomon, a legal advisor for the ministry. "If the government gives them a sense of permanence, millions more in Africa might come."

Critics call the government's treatment coldhearted and say the recent tone is fueling hatred, racism and xenophobia. In Eilat over the last month, there's been an increase in reports of Africans being pelted with rocks or doused with white paint.

Aid groups that have come to the defense of refugees say they, too, are coming under attack, receiving anonymous death threats.

"It's a frightening situation," said Orit Rubin, social coordinator at Assaf, a Tel Aviv-based organization that assists asylum seekers. Rather than calming tension, she said, government leaders are demonizing refugees, perhaps in an attempt to deflect attention from what she said is the government's failure to cope with the influx.

We are setting HP on a path to extend our global leadership and deliver the greatest value to customers and shareholders," CEO Meg Whitman said.?

The company is offering an early retirement program, so the total number of employees affected will be impacted by the number of employees that participate. The layoffs are expected to be complete by October 2014.

HP said it expects to use the savings to?boost?in?three main areas, described as "cloud, big data and security."

Shares of Hewlett-Packard (HPQ)?rose about 7 percent?to?$22.48 in after-market trading on news of the company's?cost-cutting plan and quarterly?results.?The share price has fallen nearly 50 percent over the past year.

Tech shares were among the day's biggest decliners in the market Wednesday as a weaker-than-expected revenue forecast from Dell Inc, the third-largest computer maker, spurred fears that global tech spending was declining faster than had been previously anticipated.

News of the cutbacks overshadowed the release of HP's latest quarterly results.

The company earned $1.6 billion, or 80 cent per share, during the three months ending in April, its fiscal second quarter. That represented a 31 percent decline from $2.3 billion, or $1.05 per share, at the same time last year.

If not for several items unrelated to HP's ongoing business, the company said it would have earned 98 cents per share. That figure topped the average estimate of 91 cents per share among analysts surveyed by FactSet.

Revenue for HP's fiscal second quarter fell 3 percent from last year to $30.7 billion. That was about $800 million above analyst projections.

"I wouldn't say we have turned the corner, but we are making progress," Whitman told analysts.

To pay for severance and other restructuring costs, HP expects to take a pre-tax charge of about $1.7 billion in the current fiscal year, which ends in October. It expects to take charges of an additional $1.8 billion through fiscal 2014.?

Reform of The Turkish Constitution: A Step Forward or Backward?

Turkey has been ruled since November 2002 by the Islamic-oriented Justice and Development Party, or AK Party (Adalet ve Kalkinma Partisi).? Reforming the Constitution had been a priority of the AK Party even before coming to power, and its determination to bring about substantial constitutional change has only intensified in the past few years.? A significant step was made with an amendment package put before the public in a national referendum in September 2010.? The AK Party sponsored and thus heavily favored the 26 proposed amendments; the vote in that referendum was 58% in favor with nearly 74% voter turnout.?? Western reaction to the referendum was highly positive. EU Enlargement Commissioner Stefan Fule hailed the results as a ?step in the right direction? but offered that ?other much-needed reforms? were necessary, particularly in the domains of religion and freedom of expression.[1] ?Prospective EU membership has been a partial motivation for reforms, but many other factors were involved, including an array of domestic political considerations.

Building on the momentum from the 2010 referendum, the AK Party began a process to rewrite the constitution following its success in the June 2011 parliamentary elections. Under the AK Party?s leadership, the Parliament established the Constitutional Reconciliation Commission in late summer 2011 to ?prepare the draft text of a new constitution and manage the constitution-crafting process.?[2] The Commission is designed to be ?supra-partisan? in order to craft a document with broad and deep popular support; accordingly, it is composed of 12 members, three each from the four political parties represented in parliament.[3] The proportion of the population favoring constitutional change rose from only 41% in late 2008 to nearly 69% in early 2011.[4] ?The Commission began its work on October 19 of 2011 and continues to this day, having sketched out a very rough draft on May 1.

Numerous questions emerge from this situation:? what is the AK Party?s aim in this process, and what is the general perspective of the other three parties in parliament? ?What might the proposed new constitution look like, and what might its effect be on Turkish domestic and perhaps even foreign policies?? How democratic and socially dialogical is the current constitution crafting process?? The last question is no small matter since the current Constitution, dating to 1982, was crafted by the military during its reign from 1980-1983.? Before addressing these questions, it is important to bear in mind three critical aspects of the contemporary Turkish political landscape.

First, the AK Party enjoys substantial popularity, manifested in various domains but certainly including a commanding majority of seats in the parliament through the past three national parliamentary electoral cycles.? Even though the size of its parliamentary majority has been slowly declining, the percentage of votes it won has steadily increased: 363 of 550 seats in November 2002 (34 % of the vote), 341 of 550 seats in July 2007 (46.6 % of the vote), and 336 of 550 seats in June 2011 (49.8 % of the vote). ??At the local and regional levels the AK Party also retained a commanding lead in the latest elections in 2009 even despite the unpropitious temporal context of the global financial crisis.[5]

Second, Turkish society has shown evidence of becoming more religiously oriented at least since the middle 1990s and perhaps earlier.? This reorientation is

complex but hardly universal throughout society.[6] The overall rise in religiosity has contributed to the third major point: Turkey is a deeply divided society.? The lines of division run along several axes of difference, although several of the lines intersect and some even run parallel.? Religion is a major factor in the overall configuration of divisions, however, and directly or indirectly touches each one. ?The other major line of division is the Kurdish issue, which touches at the heart of Turkey?s identity as both a nation and, given the present Constitution?s definition of? ?Turkish-ness,? also as a state.[7] Given these three characteristics of the present Turkish political landscape, the very name of the governmental apparatus for bringing about a new constitution is instructive:? the ?Constitutional Reconciliation [Uzla?ma] Commission.?? What is it likely to produce?

A major driving force behind the AK Party?s determination to alter the Constitution is its conviction that the present document, among other problems, consigns religion to a marginalized role in society.? A number of related issues all play a role, such as the role of the military in society and especially in politics, the Kurdish question, the degree of independence of the judiciary, the institutional configuration of power at the highest levels of government, the appropriate degrees of freedom for civil society-type organizations, and even the foreign policy disposition of Turkey.? Again, however, religion appears to be a fundamental and in fact a touchstone issue ?- all of the above are related to it, to one degree or another.

The AK Party?s determination to bring about a new constitution has fueled the deepening division within Turkish society to a certain degree. However, as noted above, the Constitutional Reconciliation Commission is composed of an equal number of members ? 3 ? from each of the four parties represented in parliament, and the range and depth of political disagreement among these parties is not small. These four parties are:? (1) the ruling AK Party; (2) the CHP (Republican People?s Party), the main opposition party and party of Ataturk; (3) the nationalist-oriented MHP (National People?s Party); (4) perhaps surprisingly, the Kurdish-oriented? BDP (Peace and Democracy Party).? Thus for whatever political charges one might wish to level at the ruling AK Party, it can hardly be accused of ramming and imposing constitutional change on Turkey without serious, sustained, and highly deliberative interaction among the parliamentary parties and also among the general population.

The three opposition parties all support constitutional reform in principle, but differ dramatically among themselves, and from the AK Party, in terms of what needs to be reformed. The CHP fears, among other things, a weakening of judicial independence and Turkey?s political secularism; the MHP leadership generally opposes the reform process, but its supporters are said to be divided, with 43% favoring reform, 46% opposing it, and 11% undecided; the Kurdish-oriented BDP understandably places a premium on greater Kurdish rights.? Not surprisingly, about 62-67% of AK Party supporters were said to favor constitutional reform in early 2010, but the figure is likely higher today. [8]

The Commission has engaged a broad array of civil society organizations in the deliberative process: the list of organizations, groups, and even individual citizens providing input and feedback, through the Commission, is strikingly long and deep.[9]? Furthermore, during the past few months numerous cities and localities have held public discussions in which wide arrays of opinions and concerns on the constitutional-reform issue have been advanced.[10] This process itself is not only politically healthy, but is likely to produce a document that is useful and fitting for the country given its present configuration of issues.? The process bears no resemblance to the military diktat that produced, in 1982, the foundations of the present Constitution. One would think also that a new constitution deriving from broad social dialogue might best serve the prospect of advancing Turkey?s goal of expanding the country?s foreign-policy influence in the region, all the while helping move toward resolution of the Kurdish issue.[11]

Whether or not the present constitution of Turkey provides a sufficient framework for further democratization and for continued social progress is a matter of intense dispute not only with Turkey but outside of it as well.? As noted above, the EU expressed unequivocal support for the 2010 amendments and encouraged even more change. The US did likewise.? On the other hand, numerous well-informed and politically reasoned voices within Turkey itself have argued that the present constitution is entirely adequate and though minor modifications may be in order, no wholesale re-crafting is necessary.[12]? After all, about 42% voted ?no? in the 2010 referendum. As suggested above, much of the dispute revolves around the question of the nature of the Turkish state, the role of religion in society, and even Turkey?s identity itself.

A major complaint by the AK Party about the present constitution is that its strict, French-like separation of religion and politics (la?cit?) is simply inappropriate for the increasingly religious Turkish populace. Significantly, various religious minorities agree: on February 20 of this year Eastern Orthodox Patriarch Bartholomew appeared before the Constitutional Commission, at its invitation and request, to appeal for greater religious rights in Turkey. Various religious minorities including the Alevis and others have long advocated such change. The fact that such an appeal was allowed in this venue, and was seriously heard, suggests that significant changes in Turkish politics have already occurred.

From the perspective of constitutional change, Turkey could shift from a French-style ?secular state? to a US-style ?separation of church-and-state? wherein the role of religion in the metaphoric ?public square? is considerably larger. Political change of this nature has been the intent of the AK Party and its allies, and has been underway for some time, although the strict secularists are deeply suspicious of the AK Party?s longer-term motives in this.? An even thornier problem regarding constitutional transformation is likely to be the Kurdish issue, since it touches not only on the core issue of national identity, but also on national security and even territorial integrity.? The role of this issue in any proposed constitutional change is particularly complex and daunting, since it deals with: (1) a significant portion of the country?s population claiming Kurdish identity ? perhaps as high as 15 ? 25% ? that is to some degree politically disaffected or outright alienated, and (2) with the official, constitutionally-mandated conception of the country?s identity (?all citizens are Turks?) that has its roots in the venerated Kemalist foundations of the Republic itself in the 1920s.

In conclusion, it is to be hoped that just as during the difficult 1920s when the political genius of Mustafa Kemal Ataturk brought about the modern Turkish Republic that became increasingly prosperous and democratic as the 20th century progressed, even despite serious setbacks, so also in the 21st century the current nationwide constitutional dialogue will itself evoke a similar spirit of necessary, prudent change given Turkey?s circumstances of the present age.[13]? The task is daunting indeed given the deep divisions in Turkish society, the history of military takeovers, and Turkey?s tumultuous international context. The present process, however, has been admirably participatory to date, and demonstrates a political maturity that may well serve as the foundation for an appropriate constitution, even though its details are as yet undetermined. ?Thus so far at least, the process appears to be much more of a step forward than a step backward, both for Turkey and for its frequently troubled international neighborhood.
